The Central Board of Direct Taxes (CBDT) has granted relaxation in electronic filing (e-filing) of forms 15CA and 15CB in view of difficulties reported by taxpayers in the filing of forms online on the new income tax e-filing portal. The forms can be submitted in manual format to the authorised dealers till 30th June 2021.
As per the Income-tax Act, 1961, there is a requirement to furnish Form 15CA/15CB electronically. Presently, taxpayers upload the Form 15CA, along with the Chartered Accountant Certificate in Form 15CB, wherever applicable, on the e-filing portal, before submitting the copy to the authorized dealer for any foreign remittance.
Rules relaxed for e-filing of Income Tax Forms 15CA/15CB
“In view of the difficulties reported by taxpayers in electronic filing of Income Tax Forms 15CA/15CB on the portal www.incometax.gov.in, it has been decided that taxpayers can submit the aforesaid Forms in manual format to the authorized dealers till June 30th, 2021. Authorized dealers are advised to accept such Forms till June 30th, 2021 for the purpose of foreign remittances,” the Ministry of Finance said in a statement.
“A facility will be provided on the new e-filing portal to upload these forms at a later date for the purpose of generation of the Document Identification Number,” it added.
Form 15CA and Form 15CB
When a person makes any payment or remit any money to non resident, the bank will need to check whether the tax was paid or not. The person needs to file an online form/ declaration in Form 15CA specifying nature of transaction and amount of income tax deducted on such foreign remittance.
In certain cases, this Form 15CA is also backed by a chartered accountant’s certificate in Form 15CB, who certifies that appropriate income tax has been deducted on such remittance. There are at least 28 types of foreign remittances where you do not require any submission of Form 15CA or Form 15CBIf the remittance or the aggregate of remittances is not higher than Rs 5 lakh in a particular financial year.
Taxpayers have been complaining about the difficulties since the launch of the new e-filing website – https://incometax.gov.in. on 7 June. Finance Minister Nirmala Sitharaman had flagged the technical glitches and tagged Infosys and Nandan Nilekani.
“The much awaited e-filing portal 2.0 was launched last night 20:45hrs. I see in my TL (timeline) grievances and glitches. Hope @Infosys & @NandanNilekani will not let down our taxpayers in the quality of service being provided. Ease in compliance for the taxpayer should be our priority,” said a tweet from Sitharaman’s account, which was retweeted by the Income Tax Department.
In reply to the FM’s tweet, Nilekani had said that the IT giant regrets these initial glitches and expects the system to stabilise during the week.
“The new e-filing portal will ease the filing process and enhance end user experience. @nsitharaman ji, we have observed some technical issues on day one, and are working to resolve them. @Infosys regrets these initial glitches and expects the system to stabilise during the week,” tweeted Nilekani.
